These Terms of Service ("Terms") govern your use of the website at amazingmarketing.work and any services provided by Amazing Marketing ("we", "us", or "our"), a performance marketing agency based in Kyiv, Ukraine. By accessing our website or engaging our services, you agree to these Terms.

1. Services

1.1 Scope of Services

Amazing Marketing provides performance marketing services including Google Ads campaign management, optimization, reporting, and strategy consulting. The specific scope, deliverables, and terms of any client engagement are defined in a separate written agreement.

1.2 Service Delivery

Services are delivered by our team using internal tools, including proprietary tooling built on the Google Ads API. These tools are used exclusively for managing and analyzing client campaigns and are not offered as products or services to third parties.

1.3 Client Responsibilities

To receive our services, clients are responsible for:

• Granting access to relevant Google Ads accounts via Google's OAuth 2.0 authorization process
• Providing accurate information about their business, goals, and advertising objectives
• Ensuring their Google Ads account and associated assets comply with Google's advertising policies
• Reviewing and approving campaign strategies and materials as required
• Making timely payments in accordance with agreed terms

2. Google Ads API Access

2.1 Authorization

By granting us access to your Google Ads account, you authorize Amazing Marketing to access, read, and where applicable modify campaign data for the purpose of delivering the agreed services. This authorization is established through Google's standard OAuth 2.0 protocol.

2.2 Scope of Access

We access only the accounts and data necessary to perform the services described in your engagement agreement. We do not access data beyond what is required for campaign management and reporting.

2.3 Revocation

You may revoke our access to your Google Ads account at any time through your Google account settings. Revoking access will prevent us from continuing to deliver services that depend on that access.

2.4 Compliance

Our use of the Google Ads API is governed by and fully compliant with Google's Terms of Service, Google Ads API Developer Program Policies, and the Google API Services User Data Policy, including the Limited Use requirements. We do not use API access for any purpose outside of authorized client campaign management. Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

3. Intellectual Property

3.1 Our Materials

All content on this website, including text, design, and structure, is the property of Amazing Marketing. You may not reproduce, distribute, or create derivative works from our website content without our written permission.

3.2 Internal Tools

Our internal tools, scripts, and software — including those built on the Google Ads API — are proprietary to Amazing Marketing. They are not licensed, sold, or transferred to clients as part of any engagement.

3.3 Client Materials

Any materials you provide to us (ad creatives, product data, brand assets) remain your property. You grant us a limited license to use these materials solely for the purpose of delivering the agreed services.

4. Confidentiality

Both parties agree to treat as confidential any non-public information shared in the course of an engagement. We will not disclose client account data, business information, or performance results to third parties without the client's written consent, except as required by law.

5. Payment Terms

Payment terms are defined in the individual engagement agreement. Unless otherwise agreed:

• Invoices are due within 14 days of issuance
• Late payments may result in suspension of services
• All fees are exclusive of applicable taxes

6. Limitation of Liability

Amazing Marketing provides services on a best-efforts basis. We do not guarantee specific advertising results, including particular ROAS, conversion volumes, or revenue outcomes, as these depend on factors outside our control including market conditions and platform changes.

To the maximum extent permitted by applicable law, our liability in connection with any service engagement is limited to the fees paid by the client in the three months preceding the claim.

7. Warranties and Disclaimers

We warrant that our services will be performed with reasonable skill and care. We do not warrant that our services will be uninterrupted or error-free. This website and its content are provided "as is" without warranty of any kind.

8. Termination

Either party may terminate a service engagement by providing written notice as specified in the engagement agreement. Upon termination:

• We will revoke API access tokens for the client's account
• We will cease all active campaign management activities
• Outstanding invoices for work completed prior to termination remain payable
• Any client materials provided to us will be returned or deleted upon request

9. Governing Law

These Terms are governed by the laws of Ukraine. Any disputes arising from these Terms will be subject to the jurisdiction of the courts of Kyiv, Ukraine, unless otherwise agreed in writing.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
